Private Policy

Our Privacy Policy describes how we handle the information you provide to us when you use our Services. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States, Ireland, and/or other countries for storage, processing and use by WECAST and its affiliates.

1. Information You Share With Us

We require certain information to provide our services to you. For example, you must have an account in order to upload or share content on WECAST. When you choose to share the information below with us, we collect and use it to operate our services.

Basic Account Information: You don’t have to create an account to use some of our service features, such as listening public WECAST from any device. If you do choose to create an account, you must provide us with some personal data so that we can provide our services to you. On WECAST this includes a display name (for example, “WECAST Friend”), name of your voice app (i.e. Alexa Skill of Google action) name(s) (for example, “WECAST Friend today”), a password, and an email address or phone number. Your display name and username are always public, but you can use either your real name or a pseudonym. You can also create and manage multiple WECAST  accounts, for example to express different parts of your identity.

Public Information: Most activity on WECAST is public, including your profile information, your time zone and language, when you created your account, and your WECAST Posts and certain information about your posts like the date, time, and application and version of WECAST you posted from. You also may choose to publish your location in your WECAST or your WECAST profile. The number of play counts of your WECAST, posts you GRABbed, and description of your WECAST voice apps are also public. Information posted about you by other people who use our services may also be public. For example, other people may mention you in their WECAST.

You are responsible for your posts and other information you provide through our services, and you should think carefully about what you make public, especially if it is sensitive information. If you update your public information on WECAST, such as by deleting a WECAST or deactivating your account, we will reflect your updated content on WECAST database.

In addition to providing your public information to the world directly on WECAST, we also use technology like application programming interfaces (APIs) and embeds to make that information available to websites, apps, and others for their use - for example, displaying or broadcasting WECAST posts on a news website or analyzing what people say on WECAST. We generally make this content available in limited quantities for free and charge licensing fees for large-scale access. We have standard terms that govern how this data can be used, and a compliance program to enforce these terms. But these individuals and companies are not affiliated with WECAST, and their offerings may not reflect updates you make on WECAST.

Contact Information and Address Books: We use your contact information, such as your email address or phone number, to authenticate your account and keep it – and our services - secure, and to help prevent spam, fraud, and abuse. We also use contact information to personalize our services, enable certain account features (for example, for login verification or email or SMS or notification badge), and to send you information about our services. If you provide us with your phone number, you agree to receive text messages from WECAST to that number as your country’s laws allow. WECAST also uses your contact information to market to you as your country’s laws allow, and to help others find your account if your settings permit, including through third-party services and client applications. You can use your settings for your email and mobile notifications to control notifications you receive from WECAST.

2. Additional Information We Receive About You

We receive certain information when you use our services or other websites or mobile applications that include our content, and from third parties including advertisers. Like the information you share with us, we use the data below to operate our services.

Location Information: We require information about your signup and current location, which we get from signals such as your IP address or device settings, to securely and reliably set up and maintain your account and to provide our services to you. Subject to your settings, we may collect, use, and store additional information about your location - such as your current precise position or places where you’ve previously used WECAST - to operate or personalize our services including with more relevant content like local trends, stories, ads, and suggestions for people to follow.

Links: In order to operate our services, we keep track of how you interact with links across our services. This includes links in emails we send you and links in Tweets that appear on other websites or mobile applications. If you click on an external link or ad on our services, that advertiser or website operator might figure out that you came from WECAST, along with other information associated with the ad you clicked such as characteristics of the audience it was intended to reach. They may also collect other personal data from you, such as cookie identifiers or your IP address.

Cookies: A cookie is a small piece of data that is stored on your computer or mobile device. Like many websites, we use cookies and similar technologies to collect additional website usage data and to operate our services. Cookies are not required for many parts of our services such as searching and looking at public profiles. Although most web browsers automatically accept cookies, many browsers’ settings can be set to decline cookies or alert you when a website is attempting to place a cookie on your computer. However, some of our services may not function properly if you disable cookies. When your browser or device allows it, we use both session cookies and persistent cookies to better understand how you interact with our services, to monitor aggregate usage patterns, and to personalize and otherwise operate our services such as by providing account security, personalizing the content we show you including ads, and remembering your language preferences. We do not support the Do Not Track browser option.

Log Data: We receive information when you view content on or otherwise interact with our services, which we refer to as “Log Data,” even if you have not created an account. For example, when you visit our websites, sign into our services, interact with our email notifications, use your account to authenticate to a third-party service, or visit a thirdparty service that includes WECAST content, we may receive information about you. This Log Data includes information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We also receive Log Data when you click on, view, or interact with links on our services, including when you install another application through WECAST. We use Log Data to operate our services and ensure their secure, reliable, and robust performance. For example, we use Log Data to protect the security of accounts and to determine what content is popular on our services. We also use this data to improve the content we show you, including ads. We use information you provide to us and data we receive, including Log Data and data from third parties, to make inferences like what topics you may be interested in, how old you are, and what languages you speak. This helps us better design our services for you and personalize the content we show you, including ads.

WECAST for Web Data: When you view our content on third-party websites that integrate WECAST content such as embedded timelines or Tweet buttons, we may receive Log Data that includes the web page you visited. We use this information to better understand the use of our services, to protect the safety and integrity of our platform, and to show more relevant content, including ads. We do not associate this web browsing history with your name, email address, phone number, or username, and we delete, obfuscate, or aggregate it after no longer than 30 days. We do not collect this data from browsers that we believe to be located in the European Union or EFTA States.

Advertisers and Other Ad Partners: Advertising revenue allows us to support and improve our services. We use the information described in this Privacy Policy to help make our advertising more relevant to you, to measure its effectiveness, and to help recognize your devices to serve you ads on and off of WECAST. Our ad partners and affiliates share information with us such as browser cookie IDs, mobile device IDs, hashed email addresses, demographic or interest data, and content viewed or actions taken on a website or app. Some of our ad partners, particularly our advertisers, also enable us to collect similar information directly from their website or app by integrating our advertising technology.

WECAST adheres to the Digital Advertising Alliance Self-Regulatory Principles for Online Behavioral Advertising (also referred to as “interest-based advertising”) and respects the DAA’s consumer choice tool for you to opt out of interest-based advertising at https://optout.aboutads.info. In addition, our ads policies prohibit advertisers from targeting ads based on categories that we consider sensitive or are prohibited by law, such as race, religion, politics, sex life, or health.

If you are an advertiser or a prospective advertiser, we process your personal data to help offer and provide our advertising services. You can update your data in your WECAST Ads dashboard or by contacting us directly as described in this Privacy Policy.

Developers: If you access our APIs or developer portal, we process your personal data to help provide our services. You can update your data by contacting us directly as described in this Privacy Policy.

Other Third Parties and Affiliates: We may receive information about you from third parties who are not our ad partners, such as others on WECAST, partners who help us evaluate the safety and quality of content on our platform, our corporate affiliates, and other services you link to your WECAST account. You may choose to connect your WECAST account to accounts on another service, and that other service may send us information about your account on that service. We use the information we receive to provide you features like cross-posting or cross-service authentication, and to operate our services.

Personalizing Across Your Devices: When you log into WECAST on a browser or device, we will associate that browser or device with your account for purposes such as authentication, security, and personalization. Subject to your settings, we may also associate your account with browsers or devices other than those you use to log into WECAST (or associate your logged-out device or browser with other browsers or devices). We do this to operate and personalize our services.

3. Information We Share and Disclose

As noted above, WECAST is designed to broadly and instantly disseminate information you share publicly through our services. In the limited circumstances where we disclose your private personal data, we do so subject to your control, because it’s necessary to operate our services, or because it’s required by law.

Sharing You Control: We share or disclose your personal data with your consent or at your direction, such as when you authorize a third-party web client or application to access your account or when you direct us to share your feedback with a business. If you’ve shared information with someone else who accesses WECAST through a third-party service, keep in mind that the information may be shared with the third-party service.

Subject to your settings, we also provide certain third parties with personal data to help us offer or operate our services. For example, we share with advertisers the identifiers of devices that saw their ads, to enable them to measure the effectiveness of our advertising business. We also share device identifiers, along with the interests or other characteristics of a device or the person using it, to help partners decide whether to serve an ad to that device or to enable them to conduct marketing, brand analysis, interest-based advertising, or similar activities. You can learn more about these partnerships in our Help Center. The information we share with these partners does not include your name, email address, phone number, or WECAST username, but some of these partnerships allow the information we share to be linked to other personal information if the partner gets your consent first.

Service Providers: We engage service providers to perform functions and provide services to us in the United States, Ireland, and other countries. For example, we use a variety of third-party services to help operate our services, such as hosting our various blogs and wikis, and to help us understand the use of our services, such as Google Analytics. We may share your private personal data with such service providers subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions. We share your payment information with payment services providers to process payments; prevent, detect, and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance of credit and debit cards.

Law, Harm, and the Public Interest: Notwithstanding anything to the contrary in this Privacy Policy or controls we may otherwise offer to you, we may preserve, use, or disclose your personal data if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or governmental request; to protect the safety of any person; to protect the safety or integrity of our platform, including to help prevent spam, abuse, or malicious actors on our services, or to explain why we have removed content or accounts from our services; to address fraud, security, or technical issues; or to protect our rights or property or the rights or property of those who use our services. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your personal data.

Affiliates and Change of Ownership: In the event that we are involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your personal data may be sold or transferred as part of that transaction. This Privacy Policy will apply to your personal data as transferred to the new entity. We may also disclose personal data about you to our corporate affiliates in order to help operate our services and our affiliates’ services, including the delivery of ads.

Non-Personal Information: We share or disclose non-personal data, such as aggregated information like the total number of times people engaged with a WECAST, the number of people who played, clicked on a particular link or voted on a poll in a WECAST (even if only one did), the topics that people are WECAST about in a particular location, or reports to advertisers about how many people saw or clicked on their ads.

When deactivated, your WECAST account, including your display name, username, and public profile, will no longer be viewable on WECAST. To the extent permitted by law (and unless specified otherwise by WECAST in writing), all Fees are exclusive of all taxes (including value added tax, sales tax, goods and services tax, etc.), levies or duties imposed by taxing authorities (“Taxes”), and you shall be responsible for payment of all applicable Taxes relating to your use of the WECAST Services, or to any payments or purchases made by you. If WECAST is obligated to collect or pay Taxes for the Fees payable by you, and whether or not such Taxes were added and collected from you for previous transactions, such Taxes may be added to the payment of any outstanding Fees and will be reflected in the Invoice for such transaction. We recommend that you verify the existence of any additional fees you may be charged by third parties in connection with the purchase of Paid Services or in connection with the renewal thereof (such as international transaction fees, currency exchange fees or fees due to banks or credit card companies). WECAST is not responsible for any such additional fees or costs.

As part of registering or submitting information to receive Paid Services, you also authorize WECAST (either directly or through its affiliates, subsidiaries or other third parties) to request and collect payment (or otherwise charge, refund or take any other billing actions) from our payment provider or your designated banking account, and to make any inquiries WECAST or its affiliates may consider necessary to validate your designated payment account or financial information, in order to ensure prompt payment, including for the purpose of receiving updated payment details from your payment, credit card or banking account provider (e.g., updated expiry date or card number as may be provided to us by your credit card company).

You must keep a credit card stored with WECAST to pay for your Paid Services (“Stored Card”). You will be able to identify your Stored Card by its last four digits as in your Account Settings Page.

In order to ensure that you do not experience any interruption or loss of services, certain Paid Services include an automatic renewal option by default, according to which, unless you turn-off  the auto-renewal option, such Paid Services will automatically renew upon the end of the applicable subscription period, for a renewal period equal in time to the original subscription period (excluding extended periods) and, unless otherwise notified to you, at the same price (subject to applicable Taxes changes and excluding any discount or other promotional offer provided for the first period) (“Renewing Paid Services”). For example, if the original subscription period for a Service is one month, each of its renewal periods (where applicable) will be for one month. Accordingly, where applicable, WECAST will attempt to automatically charge you the applicable Fees using the Stored Card, within up-to two (2) weeks before such renewal period commences. In the event of failure to collect the Fees owed by you, we may in our sole discretion (but shall not be obligated to) retry to collect on a later time, and/or suspend or cancel your User Account, without further notice. If your Renewing Paid Service is subject to a yearly or multiple-year subscription period, WECAST will endeavor to provide you a notice prior to the renewal of such Paid Service at least thirty (30) days in advance of the renewal date.

By entering into this Agreement and by purchasing a Renewing Paid Service, you acknowledge and agree that the Renewing Paid Service shall automatically renew in accordance with the above terms.

Certain domains are subject to a different renewal policy as detailed in the Domains Registration Agreement. Notwithstanding anything to the contrary in the foregoing, you are and shall be solely responsible to verify and ensure the successful renewal of the WECAST Services you use (whether or not such WECAST Services are subject to automatic subscription renewals). Accordingly, you shall be solely responsible with respect to any discontinuation of any WECAST Services previously purchased by you, including due to a cancellation, failure to charge the applicable recurring Fees, or due to any WECAST Services not being subject to automatic subscription renewals. You acknowledge and agree that you shall not have any claims against WECAST in relation to the discontinuation of any WECAST Services or Third Party Services, for whatever reason.

If you are not satisfied with WECAST Services that are subject to a Fee for a period of service or subscription commitment and which is your initial purchase of such service, you may provide notice of cancellation for any reason within fourteen (14) days of having first ordered or activated such WECAST Services (the “Refund” and “Refund Period”). The Refund is applicable only to the initial purchase of WECAST services which is an upgrading of a free membership by purchasing a Standard or Premium Plan (as offered on the WECAST Website). The Refund is not applicable to any additional purchases, upgrades, modification or renewals of WECAST Services. If you reside in a jurisdiction which requires a longer Refund Period, we will of course be happy to accommodate such requirements in accordance with all applicable laws. If WECAST receives such notice within such Refund Period, WECAST will refund to you the amount WECAST charged you for such WECAST Services, in currency you were originally charged in, and cancel them accordingly. Please note that the Refund amount may be different than the amount you were charged due to currency changes and third party fees. WECAST will not be responsible for any differences caused by change of currency exchange rates or fees you were charged by third parties. After the Refund Period, the Fees paid by you are non-refundable and non-cancellable. In addition, if we find that a notice of cancellation has been given in bad faith or in an illegitimate attempt to avoid payment for services actually received and enjoyed, we reserve our right to still charge the User who provided such notice for any WECAST Services actually received, as permitted by law.

Please note: Certain services purchased on or through the WECAST Services may be non-refundable. The terms of each purchased service or application are indicated on the WECAST Website and/or as part of or during the process of purchasing such services or applications. WECAST treats My Credit as service credit issued and only usable from WECAST with no monetary value. When you pay your fees with your credit your actual payment will always be deducted before your use of credit. Your credit cannot be taken out from our service unless the credit contains real money value you purchased from. For example, if you requested your refund of your payment as WECAST credit, we will realize that refunded credit has real money value and we will refund you back the credit you have left from what you paid. Note that the paid credit will be used before your credit you receive not an exchange of your payment. It is your obligation to verify your ability to cancel a service prior to purchasing it. WECAST will not refund any amounts paid for non-refundable Paid Services, applications or Third Party Services.

If, at any time, we record a decline, chargeback or other rejection of a charge of any payable Fees on your WECAST account (“Chargeback”), this will be considered as a breach of your payment obligations hereunder, and your use of the WECAST Services may be automatically disabled or terminated.

In the event a Chargeback is performed, your User Account may be blocked without the option to re-purchase or re-use it, and any data contained in such User Account, data and Third Party Services may be subject to cancellation and Capacity Loss.

Your use of the WECAST Services will not resume until you re-subscribe for any such WECAST Services, and pay any applicable Fees in full, including any fees and expenses incurred by WECAST and/or any Third Party Services for each Chargeback received (including Fees for WECAST Services provided prior to the Chargeback, handling and processing charges and fees incurred by the payment processor).

If you have any questions or concerns regarding a payment made to WECAST, we encourage you to first contact our Customer Support team before filing a Chargeback or reversal of payment, in order to prevent the WECAST Services from being cancelled and your User Account being blocked, and to avoid the filing of an unwarranted or erroneous Chargeback, which may result in your being liable for its applicable Fees, in addition to re-payment of all the Fees applicable to the WECAST Services purchased (and charged-back) by you.

We reserve our right to dispute any Chargeback received, including by providing the relevant credit card company or financial institution with any information and documentation proving that the User responsible for such Chargeback did in fact authorize the transaction and make use of the services rendered thereafter.
